ÖZ:
Kamuda istihdam edilen alt işveren işçilerinin sendikalaşması ve yetkili işçi sendikalarının bu işçiler adına toplu iş sözleşmesi imzalamalarının önünde büyük engeller bulunmaktaydı. 6552 sayılı Kanundan önce imzalanan toplu iş sözleşmeleri de mevzuattan dolayı uygulanmamaktaydı. Bu engelleri ortadan kaldırmak için 6552 sayılı Kanun ile yeni bir düzenleme getirilmiştir. Bu düzenleme ile alt işverenlerin kamu işveren sendikalarını yetkilendirmeleri ve bu Kanuna dayanarak yetkili işçi sendikalarının kamu işveren sendikaları ile toplu iş sözleşmesi imzalamalarına imkân tanınmıştır. Ancak bu düzenleme birçok sorunu da beraberinde getirmiştir. Yetkilendirmenin mevzuata uygun nasıl yapılacağı, bu süreçte yaşanan sorunlar ve kamudaki alt işveren işçilerinin kadroya alınması ile ilgili alternatif çözüm önerileri bu yazıda ele alınmıştır.

ABSTRACT:
There were major obstacles to the unionization of sub-contractor workers employed in the public sector and the signing of collective bargaining agreements by authorized trade unions on behalf of these workers. Collective agreements concluded before the Law No. 6552 were not implemented due to the legislation. A new regulation has been introduced with the Law No. 6552 to remove these obstacles. This arrangement allows sub-contractors to authorize public employers’ unions and, based on this Law, authorized trade unions sign collective agreements with public employers’ unions. However, this regulation brought many problems. It is discussed in this article how to make the authorization properly in legal sense, the problems experienced in this process, and the alternative solutions such as employment of sub-contractor workers as permanent employees in the public sector.
