ÖZ:
Almanya'daki sosyal piyasa ekonomisi, “Freiburg Okulu” olarak adlandırılan ordoliberalizmin üyeleri tarafından kararlı bir şekilde başlatılmış ve teorik olarak şekillendirilmiş olsa da, manevi akıl hocası ve öncüsü tartışmasız iktisatçı ve sosyolog Alfred Müller-Armack'dır. Ne var ki ekonomi düzenine dair politika konseptinin başarısı, sosyal devletin ve bunun yasal teorik temellerine yönelik ilginin arka plana itilmesine neden oldu. Bu bağlamda ordo-liberal ilkelerin uygulanmasında devletin müdahalesinin sosyal kapsamı ve yoğunluğu sorunu özellikle önem arz etmektedir. Müller-Armack’ın bizzat talep ettiği ekonomi düzeninin ve sosyal devletin karşılıklı bağımlılığı, şimdiye kadar sadece tekil yönleriyle tartışıldı. Bu çalışma, bu yaklaşımları genişletmeyi ve disiplinler arası bir analizle sosyal piyasa ekonomisi, sosyal devlet, hukuk ve anayasanın Müller-Armack'ın epistemolojik ve ekonomik temelinde bütüncül konseptinin ayrılmaz bileşenleri olarak önemini göstermeyi amaçlamaktadır. Bu doğrultuda bu makalede Müller-Armack’ın sosyal piyasa ekonomisi konseptinden ne anladığı ve Alman sosyal devletinin oluşumundaki katkıları incelenmektedir.

ABSTRACT:
Although the social market economy in Germany was decisively initiated and theoretically shaped by the ordoliberalism members of so-called “Freiburg School”, its spiritual mentor and pioneer is undisputed the economist and sociologist Alfred Müller-Armack. But the success of his economic policy concept made interest in its social state and legal theoretical foundations fade into the background. In this context, the question of the social extent and intensity of state participation in the implementation of ordo-liberal principles is of particular importance. The interdependence of the order of the economy and the social state, called for by Müller-Armack himself, has so far only been discussed in singular aspects. The present work aims to expand these approaches and to demonstrate in an interdisciplinary analysis the importance of the social market economy, social state, law and constitution as integral components of Müller-Armack's epistemologically and economically well-founded overall concept. In this direction, this article examines what Müller-Armack understands from the concept of social market economy and his contributions to the formation of the German social state.
