ÖZ:

Sosyal sigorta kurumlarını diğer kamu hizmeti veren kamu kurumlarından ayıran temel ve ayırıcı özelliklerinin başında idari ve mali bakımdan özerk olmaları gelir. 1990’lı yılların başından itibaren finansman açıkları vermeye başlayan Türk sosyal sigorta kurumları, mali özerkliklerini de kaybetmişlerdir. Sosyal sigorta kurumlarının idari özerkliği ise fiili müdahaleler dolayısıyla çok sınırlı bir uygulama imkânı bulmuştur. Kurumların idari ve mali özerkliğinin zayıflığı kurumları; emeklilik yaşının değiştirilmesi ve prim afları gibi sisteme sosyal sigortacılık ilkelerine aykırı müdahalelerin konusu haline getirmiştir. Sosyal güvenlik reformunun bir ayağını oluşturan kurumsal yapıya yönelik düzenlemelerle ilgili 5502 sayılı Sosyal Güvenlik Kurumu Kanunu ile iki önemli değişiklik yapılmıştır. Bunlardan ilki daha önce üç ayrı kurum tarafından yapılan bütün sosyal sigortacılık işlemlerinin yeni “tek çatı” kurumu Sosyal Güvenlik Kurumu (SGK) tarafından yerine getirilmesidir. İkincisi ise SGK’ya sosyal güvenlik politikalarının uygulanması ve geliştirilmesi görevinin verilmesidir. SGK’nın bu yeni görev alanı ile ilgili etkinliği arttıkça, sisteme yönelik “akılcı olmayan” müdahaleler azalacak, Kurumun hem idari hem de mali özerkliği güçlenecekti. Ancak, 2006 yılından günümüze kadar geçen 17 yıllık sürede SGK’nın bu ikinci görevi ile ilgili faaliyetleri hem yetersiz kalmış, hem de Kurumda bu görev alanı ile ilgili beklentiler de azalmıştır. SGK, birkaç istisnai faaliyet dışında, tamamen sosyal sigortacılık hizmetleri yapan, etkinlik ve başarı kriterlerini de bu görev alanı ile ilgili gelişmelerle belirleyen bir Sosyal Sigorta Kurumuna yani SSK’ya dönüşmek üzeredir. Bu, sosyal güvenlik reformunun başlangıç hedef ve amaçlarına aykırı “tersine bir dönüşüm” veya “tersine reform” anlamına gelmektedir.

ABSTRACT:

The main and distinctive feature that distinguishes social insurance institutions from other public institutions providing public services is their administrative and financial autonomy. Turkish social insurance institutions, which started to run financial deficits since the early 1990s, have lost their financial autonomy. Administrative autonomy of social insurance institutions, on the other hand, found a very limited application opportunity due to actual interventions. The weakness of the administrative and financial autonomy of the institutions has made it the subject of interventions against the social insurance principles, such as changing the retirement age and premium amnesties. Two important changes were made with the Social Security Institution Law No. 5502, regarding the regulations regarding the institutional structure, which is one of the pillars of the social security reform. The first of these is the fulfillment of all social insurance transactions, previously carried out by three separate institutions, by the new "single roof" institution, SGK. The second is to assign the SGK the task of implementing and developing social security policies. As the SGK's effectiveness in this new field of duty increased, "irrational" interventions towards the system would decrease, and both the administrative and financial autonomy of the Institution would be more strengthened. However, in the 17 years since 2006, the activities of the SGK regarding this second duty have been insufficient and the expectations from the Agency regarding this duty area have also decreased. Apart from a few exceptional activities, SGK has transformed into a Social Insurance Institution, namely SSK, which provides social insurance services and determines the efficiency and success criteria with the developments related to this field of duty. This means a "reverse transformation" or "reverse reform" against the initial goals and objectives of the social security reform.
