ÖZ:

Avrupa endüstri ilişkiler sistemi içerisinde son derece önemli bir rol üstlenmiş durumdadır. Bugün sayıları 1.500 civarında olan bu konseyler, çokuluslu şirketlerde istihdam edilen işçilerin katılım haklarını Avrupa Birliği ölçütünde teminat altına almaktadır.

Bu çalışmada ilk olarak Avrupa İş Konseylerinin ortaya çıkış süreci ve gelişimleri genel hatlarıyla ortaya konduktan sonra, yürürlükte olan 2009/38/EG sayılı Direktiflerin hükümleri doğrultusunda bu konseylerin kuruluşları, görev ve yetkileri, faaliyet alanları incelenecektir. Uygulamaya ilişkin verilere de yer verilmek suretiyle etkinlikleri analiz edilerek Avrupa Birliği’ne aday olan Türkiye için de bir perspektif ortaya konmaya çalışılacaktır.

ABSTRACT:

European Business Councils (European Works Councils) have played an important role in the European industrial relations system for almost a quarter of a century. Today, these councils, which are around 1.500, guarantee the participation rights of workers employed in multinational companies in the European Union.

In this paper, firstly, after the emergence and development of the European Business Councils are explained in general terms, the organizations, duties and powers and activities of these councils will be examined in accordance with the provisions of Directive 2009/38/EG in force. The activities of the Council will be analyzed by considering data on implementation and a perspective will be attempted to present. for Turkey is the candidates to the European Union

ÖZ:
Bu çalışmada 6356 sayılı Sendikalar ve Toplu İş Sözleşmesi Kanunu’nun 75/6’ıncı maddesine göre mahkeme kararından sonra işçi sendikasının yetki belgesinin ne olacağı konusu incelenmiştir. 6356 sayılı Kanunda hangi hallerde yetki belgesinin düşeceği tek tek sayılmıştır. Ancak, 6356 sayılı kanunun 75. maddesinin son fıkrasında yetki belgesinin düşeceğine dair bir düzenleme yapılmamıştır. Dolayısıyla burada kanun koyucu tarafından düzenlenmesi unutulmuş açık bir boşluk bulunmaktadır. Bu durumda işçi sendikasının yetki belgesinin düşüp düşmeyeceği yahut ne kadar süre ile devam edeceği konusunun belirlenmesi gerekmektedir. Hukuk Genel Kurulu, incelediğimiz bu kararında işçi sendikasının yetkisinin düşeceğine karar vermiştir. Ancak, kanaatimizce 6356 sayılı Kanunun 75. maddesinin son fıkrasına göre yetki tespit başvuru tarihindeki üyelerinin dörtte üçünü kaybettiği tespit edilen sendikanın uygulamaya koyduğu grevin sona erdirilmesine mahkemece karar verilmesi ile yetki belgesi düşmeyecektir. Bu inceleme neticesinde kanun koyucu tarafından düzenlenmesi unutulmuş bu açık boşluğun nasıl çözülmesi gerektiği de gösterilmiştir.

ABSTRACT:
In this study, the legal status of trade union’s certificate of competence following the court decision according to article 75/6 of the Trade Unions and Collective Labor Agreements Act no 6356 was examined. The Law no. 6356 has specified the conditions in a case by case manner where the certificate of competence shall be deemed void. However, no provision to clarify the status of this certificate as null and void has been made in the last paragraph of Article 75 of the Law no.6356. Therefore, there is a clear regulatory gap which is presumably forgotten by the legislator. In this case, it is necessary to determine whether the trade union's certificate of competence will annul or how long it will continue its existence. In the decision which we examined, the General Law Chamber of the Court of Appeals decided that the competence of the trade union will be annulled. However, in our opinion, in accordance with the last paragraph of article 75 of the Law No. 6356, losing its three quarters of its members at the date of the application for the determination of the competence and the annulment of the strike by the court decision, shall not automatically lead to the nullification of the certificate of competence. As a result of this examination, it was also shown how this explicit regulatory gap should be solved by the legislator.

ÖZ:
Çin Halk Cumhuriyeti (ÇHC), 40 yıla yayılan yüksek büyüme performansı neticesinde küresel ekonomi içindeki ağırlığını her geçen yıl arttırmaktadır. Ülke son yıllarda dolaysız sermaye yatırımları ile de gündeme gelmektedir. Dolaysız sermaye atılımının mevcut aşaması “Bir Kuşak, Bir Yol” girişimidir. Bu çalışmada, söz konusu girişimin Akdeniz dünyası üzerindeki mevcut ve olası etkileri üzerinde durulmaktadır. Buna ek olarak ÇHC-Akdeniz dış ticareti, fırsatlar ve kısıtlılıklar çerçevesinde analiz edilmektedir. Bir Kuşak, Bir yol Girişimi’nin, başta Doğu Akdeniz ekonomisi olmak üzere, Akdeniz ülkeler grubu için önemli fırsatlar sunduğuna işaret edilmiştir. Gerçekleştirilecek dolaysız yatırımların liman altyapısını geliştirici potansiyeline vurgu yapılmıştır. Buna ek olarak ÇHC-Akdeniz ticaretindeki dengesiz yapı çalışmanın saptamaları arasındadır. Akdeniz ülkeler gurubu içinde Çin piyasasında varlık gösterme imkânı bulan ülke sayısının oldukça sınırlı olduğu görülmüştür.

ABSTRACT:
As a result of the high growth performance spreading over 40 years, People’s Republic of China (PRC) is increasing its influence in the global economy every passing year. In recent years, the country has also come to the agenda with outward capital investments. The current stage of the direct capital leap is the “One Belt, One Road” initiative. This study focuses on the current and potential impacts of the “initiative” on the Mediterranean world. In addition, PRC-Mediterranean trade is analyzed in terms of opportunities and constraints. It has been pointed out that One Belt, One Road Initiative presents important opportunities for the Mediterranean countries group, especially the Eastern Mediterranean economy. Emphasis has been placed on the potential of direct investments to develop port infrastructures. In addition, the unbalanced structure in the PRC-Mediterranean trade is among the determinations of the study. Within the Mediterranean countries group, the number of countries having presence in the Chinese market is very limited.
